Terms and Conditions of Moxie Driving Academy Inc.
Responsibilities and rights of Moxie Driving Academy Inc. (the School)

The school will provide training in a timely and professional manner.

The driver training vehicle will be clean and in good running condition with a valid license plate, registration and proper insurance. The vehicle will also be equipped with proper roof top sign, dual brake and rear view mirror for instructor sitting on the passenger seat.

In-class training will be conducted within a facility which meets the requirements from Alberta Transportation. In-class sessions will be 15 hours long in total, not including break time or exam time. A chargeable Class 5 Driver Education Curriculum: A Guide for Students will be available for each student for a fee. Student can also opt for online Class 5 Driver Education.

The driving instructor, in-vehicle or in-class or online course, is licensed by Alberta Transportation and will produce his or her instructor’s licence and operator’s licence upon request.

If the school has to cancel a lesson(s) due to instructor illness, vehicle break down, etc., every effort will be made to accommodate the student and to reschedule the lesson. The school will inform the student of the cancelation and rescheduling as early as possible.

If the vehicle breaks down or illness of the instructor occurs while the student is being trained, student has to arrange and/or pay his/her transportation by himself/herself. School will organize and reschedule the remaining time of the interrupted-training after consulting with the student.

An in-vehicle report card/student summary with a detailed evaluation (electronic or paper) will be completed and explained by the instructor at the end of each lesson. All the training record will be maintained by the school, and might be sent to the student upon request at the school’s discretion.
Responsibilities of the Student

The student must possess a minimum class 7 Alberta license or equivalent licence from other jurisdiction and have the license in their possession during all in-vehicle training.

The student who attends a course that offers a ‘Driver Education Course Completion Certificate’ must have the required minimum hours of training for the specific course and must pass the applicable written test with minimum 80 percent and in-vehicle performance evaluation of minimum 7.5, before they can receive the certificate.

If the student chooses for the On-Line Novice Classroom Program, he/she should finish it within 30 days or as instructed during the online course registration.

Any acts of negligence on the Student’s part that result in damages or fines will be the responsibility of the student.

Learning to drive must be taken seriously. Students are expected to give best efforts during classroom and in-vehicle lessons. Unacceptable behaviour (drinking, drugs, swearing, continually being late, etc.) will not be tolerated and the School may discontinue the lesson at the Student’s expense.

During a Driver Training lessons, in-classroom or in-vehicle, all electronic communication devices (e.g., cell phones) must not be used by the student.

Students are expected to come at the correct location and on time according to the in-vehicle lesson schedule. There is no refund or reschedule for the missing lesson(s) if the student does not come within 15 minutes from the lesson start time.
Cancellation and Refund
- Once the student register, the student must finish the course within 12 months from the registration date. If the student wants to cancel the remaining courses within 12 months, the school will refund the remaining amount from the total course amount by deducting the services already delivered on a pro-rata basis plus a 15 per cent of the total course amount as a processing fee. In case that the student can’t finish the course registered within 12 months and has not cancelled the course , the school will not refund or reschedule for the remaining lesson(s) or service(s).

In case the student wants to cancel or reschedule the in-vehicle lesson, they must inform the school by talking to the school in person or on the phone at least 48 hours or more prior to the lesson. The school will reschedule the date at no additional cost.

A no show fee of $125+GST will be charged to the student, if the student makes the cancellation (for any reason including sickness or emergencies) of the in-vehicle lesson(s) less than 48 hours prior to the in-vehicle lesson(s)’s start time. There is no refund or rescheduling for the missed lesson(s) if the student does not come for the training within 15 minutes from the scheduled in-vehicle lesson(s) start time or cancel the lesson after the scheduled in-vehicle lesson(s) start time.

If the student wants to cancel the whole course and the whole course has not started yet and if a written refund request is received from the student 48 hours or more prior to the course start, the school will charge 15 percent of the total course amount. If a written refund request is received less than 48 hours prior to the course start, the school will charge 20 percent of the total course amount.
Student Registration
Personal Information Collection Statement: All personal information collected and held by the Driving School is protected under the Privacy Act. The information is used to identify you to register and log you into our online services and other administration purpose. The information may also be used for statistical, evaluation and reporting purposes. We may share personal information with the appropriate law enforcement authorities for criminal investigation purpose. Personal information such as credit card number, name on the credit card is not collected or held by the Driving School when you conduct online payment and leave our website before you finish the payment.

An additional fee of 3 percent of the total invoice amount be charged (non-refundable*) if the payment is made using the credit card/debit card Paypal or other online payment system. In case of the returned cheque for non-sufficient funds, there will be an additional fee of $60.
*Beginning from November 13, 2023 as per the Paypal policy change, if we issue a refund to a buyer, the transaction fees charged by the Paypal or credit card won’t be returned to the buyer. This change is aligned with the Paypal refund policy change as they are not going return us the transaction fee.
NOTE: Student can wear a face mask during the in-car training. But if he/she is sick or with flu symptoms, cold or cough, he/she must wear a face mask.
